What is the role of a YouTube lawyer ?

Why a lawyer specialized in YouTube ?

YouTube is more than a platform: it's a professional ecosystem where creators build businesses, audiences and livelihoods. But this ecosystem operates under rules, YouTube's Terms of Service, Community Guidelines and Content ID system, that can threaten your channel at any moment. A single copyright strike can cut your monetization.

Three strikes and your channel disappears. INFLUXIO, a firm specializing in influencer law and intellectual property, defends YouTubers against these threats, from Content ID disputes to commercial litigation with a brand or an agency.

Content ID: understanding and contesting.

Content ID is YouTube's automated system that scans uploaded videos against a database of reference files submitted by rights holders. When a match is detected, the rights holder can choose to block the video, monetize it (claim ad revenue), or track its viewership statistics.

How Content ID works.

Content ID uses audio and visual fingerprinting to detect matches. The system is automated and imperfect: it cannot assess fair use, parody, commentary or transformative use. Many legitimate creators receive erroneous claims.

Contesting a Content ID claim.

YouTubers can file a dispute if they believe the claim is incorrect. If the claimant rejects the dispute, the creator can appeal. If the appeal is rejected, the creator can file a counter-notification under the DMCA (or equivalent local law). INFLUXIO drafts legally grounded disputes and counter-notifications to maximize success rates.

Fraudulent or abusive claims.

Some entities systematically file false Content ID claims to monetize others' content or to silence criticism. These practices constitute abuse of rights and can be challenged legally. INFLUXIO identifies abusive claimants and takes appropriate legal action.

Copyright strikes: defense and prevention.

A copyright strike is a formal legal notice from a rights holder alleging copyright infringement. Unlike Content ID claims, strikes directly threaten the channel.

Consequences of strikes.

One strike: loss of certain features (live streaming, custom thumbnails). Two strikes: temporary upload restriction. Three strikes: channel termination. Each strike remains active for 90 days.

  • Loss of monetization and YouTube Partner Program benefits
  • Loss of custom URL and channel features
  • Risk of complete channel deletion with all content

Counter-notification: your legal defense.

The DMCA counter-notification is a sworn legal statement affirming that the content does not infringe copyright. The claimant then has 14 business days to file a lawsuit or the content is restored. INFLUXIO prepares counter-notifications with proper legal argumentation.

Preventive measures.

Use royalty-free music and assets, secure synchronization licenses for music, document your creative process, register your own works for reference. INFLUXIO helps you build a bulletproof content creation workflow.

Monetising YouTube involves precise legal choices.

Channel suspension and account termination.

YouTube may suspend or terminate channels for repeated copyright violations, Community Guidelines breaches or Terms of Service violations.

YouTube's internal appeal process.

YouTube offers an internal appeal for terminated channels. The appeal must demonstrate that the termination was erroneous or that corrective measures have been taken. INFLUXIO drafts compelling appeals that address YouTube's specific concerns.

Legal action against YouTube.

In extreme cases, legal action against Google/YouTube may be necessary. While challenging, French and EU courts have jurisdiction over content removal disputes affecting EU-based creators. The Digital Services Act (DSA) provides additional avenues for challenging platform decisions.

Contracts and monetization for YouTubers.

Beyond platform issues, YouTubers face complex contractual challenges.

Sponsorship and brand deals.

The French Law of June 9, 2023 requires written influencer contracts when the total fees exceed €1,000 excl. VAT per year and per advertiser (threshold set by decree since January 1, 2026). INFLUXIO drafts and negotiates sponsorship agreements that protect the creator's creative freedom and intellectual property.

MCN (Multi-Channel Network) contracts.

MCN contracts must be carefully reviewed: revenue share, contract duration, exclusivity, rights assignment, termination conditions. Many MCN contracts contain clauses unfavorable to creators.

Merchandising and derived products.

Channel-branded merchandise raises trademark, design and licensing questions. INFLUXIO handles trademark registration and merchandising agreements.

Protecting your YouTube brand.

Your channel name, logo and visual identity are valuable assets that must be legally protected.

Trademark registration.

Register your channel name as a trademark at INPI (France) or EUIPO (Europe) to prevent impersonation and protect your brand across platforms.

Fighting impersonation.

Fake channels, identity theft and content theft are rampant on YouTube. INFLUXIO takes swift action through platform reporting, legal notices and court proceedings when necessary. We also handle image rights and identity theft claims.

Legal levers for professionalising a YouTuber.

Legally structuring your YouTube activity.

Legal structuring becomes essential as soon as your revenue grows significantly.

Legal status (sole trader, SASU, SAS).

Micro-entrepreneur status to start out (below €83,600 under micro-BNC and for BIC services; below €203,100 for sales of goods and accommodation). SASU for a solo creator exceeding those thresholds. SAS for a project run with a team. See our startup lawyer page.

Taxation and income reporting.

AdSense revenue (BIC/BNC), brand partnerships (services), affiliate income (commissions). VAT applies beyond the exemption thresholds.

Contracts with your team.

Contracts with editors, graphic designers and community managers: copyright assignment, confidentiality, remuneration.

Monetisation and tax aspects.

The YouTube Partner Program (AdSense), Super Chats, channel memberships, merchandising (e-commerce) and YouTube Premium: each revenue stream requires appropriate accounting and tax treatment.

Useful glossary in YouTube law.

DMCA (Digital Millennium [Copyright](/en/avocat-droit-dauteur) Act)
1998 US law underpinning the notice-and-takedown mechanism used by YouTube to remove infringing content, with possible counter-notification procedure.
Content ID
YouTube's automatic content identification system enabling rights holders to block, monetize or track the use of their works on the platform.
YouTube strike
formal warning issued by YouTube to a creator for copyright infringement or breach of terms of service; three strikes result in permanent channel deletion.

FAQ

Frequently asked questions.

No, unless you have authorisation or fall within a legal exception (short quotation, parody). Unauthorised use triggers a Content ID claim or a copyright strike. Use the YouTube Audio Library or licensed catalogues.

Micro-entrepreneur status to start out (thresholds updated by Law No. 2025-127 of 14 February 2025: €83,600 per year under micro-BNC and for BIC services, and €203,100 per year for sales of goods and accommodation). SASU for a solo creator with higher revenue. SAS for a project run with several people.

A written contract is mandatory above €1,000 excl. VAT (threshold set by decree). Below that, it remains strongly recommended.

Don't panic. Analyze the claim, determine if it's valid. If your content is original or falls under fair use/parody, file a counter-notification. INFLUXIO can draft a legally grounded counter-notification to maximize your chances.

Yes. YouTube provides a dispute process. If the claimant rejects your dispute, you can appeal. If that fails, you can file a DMCA counter-notification. Legal argumentation significantly improves success rates.

Use royalty-free music and assets, secure proper licenses, document your creative process, avoid using third-party content without authorization, and register your own works in Content ID.

YouTube can terminate channels for severe or repeated violations. However, EU-based creators have enhanced protections under the DSA. INFLUXIO can challenge unjustified terminations through internal appeals and legal action.

Since January 1, 2026, written contracts are mandatory when the total fees exceed €1,000 excl. VAT per year and per advertiser. Even below this threshold, a lawyer ensures fair terms: limited rights assignment, creative control, proper compensation and clear deliverables.

Register your channel name as a trademark at INPI or EUIPO. This prevents impersonation, gives you legal tools against copycats, and protects your brand across all platforms and merchandise.
